What is an Apostille?

An apostille is a government-issued authentication certifying that your personal or commercial documents are valid for use in foreign countries.

This certification ensures that birth certificates, marriage certificates, diplomas, and business documents are legally recognized abroad. Apostilles are essential for individuals and businesses navigating international requirements.

Why Are Apostille Essential For Individuals?

An apostille guarantees that essential documents, such as birth certificates, marriage licenses, and academic credentials, are recognized in foreign countries. For example, a properly apostilled marriage certificate is crucial for legal recognition if you are getting married overseas.

Why Are Apostille Essential For Businesses?

Businesses operating internationally rely on apostilled documents like articles of incorporation or certificates of good standing to meet legal and regulatory requirements in foreign jurisdictions. Without this authentication, critical business operations may be delayed or disrupted.

Apostille or Legalization

The Secretary of State issues two types of authentications of public documents, either apostilles or authentications. Apostilles are used by countries participating in the Hague Convention. Authentication is used by countries that do not participate.

Wisconsin, and every other state, only authenticate signatures on documents that have been issued in Wisconsin—if you have a document originating in another state, that state can only perform authentication. Wisconsin will not authenticate documents issued from other states, federally issued documents, or documents issued from other countries.

Non-Hague Convention countries can require additional review by the United States Department of State or by the embassy of the destination country.

Will I Get An Apostille?

For a list of the countries that are in the Hague Convention and accept apostilles, please visit the Status Table provided by the Hague Conference on Private International Law.

If your destination country isn’t a part of the Hague Convention, authentication will not be an apostille.
